TERMS AND CONDITIONS OF SALE

Fever Labs, Inc.

1. INTRODUCTION

Welcome to the official Formula 1 Ticketing platform for Events relating to the 2027-2031 FIA Formula 1 World Championships. These Terms and Conditions of Sale ("Terms") govern all purchases from Fever Labs, Inc (or Fever Affiliates as defined at Section 5.5) of Tickets, hospitality packages and related products through the F1 Ticketing Website at ticketing.formula1.com (the "Platform").

The Platform is operated by Fever Labs, Inc. ("Fever", "we", "us" or "our"), a company incorporated in the USA, with its principal office at 483 Broadway, Level 2, New York, NY 10013. Fever operates the Platform under its official supplier agreement with Formula One Digital Media Limited ("FODM"), which is part of the Formula 1 group of companies.

These Terms also govern your access to and use of the Platform. By accessing or using the Platform, creating any account required, placing an Order, or otherwise using any part of the Platform or the services made available through it, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform or purchase any Products.

Scope

These Terms apply to the sale of Products, being grandstand Tickets, general admission Tickets and Promoter-operated hospitality packages sold by us.

Certain products are subject to additional terms imposed by the relevant Event promoter or circuit operator ("Promoter Terms" see definition below) and, in the case of F1 Products, by Formula One Hospitality and Event Services Limited ("FOHES"). Where there is a conflict between these Terms and the Promoter Terms, the order of precedence is set out in Section 12.

These Terms do not cover any goods or services purchased from third parties, including travel, accommodation, transport, or merchandise not sold through the Platform.

2. DEFINITIONS

In these Terms, the following capitalised expressions have the meanings set out below:

"Business Day" means a day other than a Saturday, Sunday or public holiday in the jurisdiction of the relevant Event.

"Customer" means the individual who uses the Platform and/or places an Order through the Platform (also referred to as "you" or "your").

"Customer Database" means the database of Customer information maintained by Fever in connection with the Platform.

"Event" means a Formula 1 race weekend, including all practice sessions, qualifying sessions, sprint events and the Grand Prix, or any other event for which Tickets are sold through the Platform.

"F1 App" means the official Formula 1 mobile application.

"F1 Products" means Paddock Club packages and other hospitality products sold by or on behalf of FODM through the Platform.

"F1 Ticketing Website" means the website at ticketing.formula1.com which is operated by Fever under its official supplier agreement with FODM.

"FODM" means Formula One Digital Media Limited, a company within the Formula 1 group.

"FOHES" means Formula One Hospitality and Event Services Limited, a company within the Formula 1 group and the entity responsible for Paddock Club and FODM hospitality operations.

"Non-Ticket Product" means any product made available for purchase through the Platform that does not itself constitute a Ticket granting admission to an Event (for example digital content, hospitality benefit, merchandise, programme, or experiential item).

"Order" means a binding purchase of one or more Products made by a Customer through the Platform.

"Order Confirmation" means the confirmation email and/or in-app notification sent by Fever confirming the acceptance of an Order.

"Payment Processing Costs" means any non-refundable fees charged by third-party payment processors in connection with the processing and refunding of a payment.

"Platform" means the F1 Ticketing Website and any related mobile applications or digital channels through which Products are sold.

"Product(s)" means (a) grandstand Tickets and general admission Tickets; and (b) Event hospitality packages, in each case sold by us through the Platform.

"Promoter" means the entity licensed by the Formula 1 group to organise and stage an Event at a specific circuit.

"Promoter Terms" means any additional terms, conditions, regulations or rules imposed by the Promoter or circuit operator applicable to attendance at an Event with each relevant Promoter Terms set out in the table at Section 5.5.

"Shipping Fees" means any fees charged for physical delivery of Products, where applicable.

“Ticket” means a physical or electronic pass granting access to an Event, with each Ticket type being purchased and described as part of a Product;

"Total Price" means the total amount paid by the Customer for an Order, including the face value of the Product(s), any applicable taxes, service fees, Shipping Fees and Payment Processing Costs.

3. ELIGIBILITY

You must be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) to place an Order through the Platform. By placing an Order, you represent and warrant that you meet this requirement.

If you are purchasing Tickets on behalf of a group, you are responsible for ensuring that all members of the group comply with these Terms and any applicable Promoter Terms.

4. CONTRACT FORMATION

4.1 Placing an Order

All Products displayed on the Platform constitute an invitation to treat and do not constitute a binding offer. When you submit an Order through the Platform, you are making an offer to purchase the selected Products on these Terms.

4.2 Acceptance

A binding contract between you and Fever is formed only when we successfully receive payment and we send you an Order Confirmation. We reserve the right to refuse or cancel any Order at any time prior to sending the Order Confirmation, including where:

  • the Product is unavailable, mispriced or incorrectly described;
  • we are unable to verify your identity or payment information;
  • your Order triggers our fraud detection systems; or
  • your Order breaches any purchase limit or other restriction.

4.3 Order Limits

We may impose limits on the number of Products that may be purchased per Customer, per payment method or per Event. Any attempt to circumvent these limits (including by using multiple accounts or identities) may result in cancellation of Orders and suspension of your access to the Platform.

4.4 Confirmation and Records

Your Order Confirmation will be sent to the email address registered with the Platform and will be available in your account dashboard. You should retain a copy of these Terms and your Order Confirmation for your records.

5. PRODUCTS AND AVAILABILITY

5.1 Availability

All Products are subject to availability. Product listings on the Platform are updated in real time wherever possible, but we do not guarantee that any Product will remain available at the time your Order is processed.

Certain Products may be released in phases or subject to delayed release. Where a Product is subject to delayed release, this will be indicated on the Product listing page.

5.2 Seating and Allocation

Unless a specific seat is guaranteed at the point of purchase, your seating or standing allocation may be assigned by Fever, the Promoter or the circuit operator. We will use reasonable efforts to honour any stated preferences but cannot guarantee specific views, positions or proximity to the track.

5.4 Accuracy

We take reasonable care to ensure that Product descriptions, images and other information on the Platform are accurate. However, images are for illustrative purposes only and the actual experience may differ. We reserve the right to correct any errors in Product descriptions or pricing at any time.

5.5 Fever Affiliates and Local Promoter Terms

Depending on the location of the Event, your contract for the purchase of Products may be with Fever Labs, Inc. or one of its affiliated companies identified in the table available below (each a "Fever Affiliate"). Therefore all references in these Terms to "Fever", "we", "us" or "our" shall also mean the applicable Fever Affiliate that sells the relevant Product to you.

6. PRICES, FEES AND CURRENCY

6.1 Pricing

All prices displayed on the Platform include applicable taxes unless otherwise stated. Prices may vary by Event, Product category, purchase date and demand.

In addition to the face value of the Product, your Order may include:

  • service fees and booking fees;
  • Payment Processing Costs;
  • Shipping Fees (for physical delivery, where applicable); and
  • any other fees clearly disclosed during the checkout process.

The total amount payable will be displayed before you confirm your Order. Any customs duties, import taxes, clearance fees or similar charges arising from international delivery of Products are the responsibility of the Customer.

6.2 Currencies

Prices for the Products displayed on the Platform shall be displayed to Customers in multiple currencies and include the currency applicable to the location of the Event (for example EUR for Events in Europe, USD for Events in USA, GBP for the Event in the UK). Fever shall determine, acting reasonably and taking into account the location of the relevant Event and the Customer, which of the available currencies are offered for each Event and Transaction.

The currency in which the Customer's payment will be processed (the “Final Payment Currency”) shall be clearly displayed to the Customer before checkout. Once selected and confirmed by the Customer, all prices, fees and charges for that Transaction shall be displayed and charged in the Final Payment Currency.

6.3 Currency Conversion

Where you pay in a currency other than the master currency, the conversion will be performed at the exchange rate applicable at the time of payment. Exchange rates are determined by our payment processor . Any exchange rate fluctuations between the date of payment and the date of any refund are applied by your bank or payment provider and may affect the amount received by you.

6.4 Price Changes

Prices may change at any time prior to the formation of a binding contract. Once we have sent you an Order Confirmation, the price stated in that confirmation will not be increased. The price paid at the time of purchase represents the agreed purchase price for the Ticket and you will not be entitled to a refund, credit or price adjustment because: (i) the face value printed on the Ticket differs from the price paid; or (ii) the price of the same or similar Ticket subsequently increases or decreases.

6.5 Pricing Errors

Whilst we take reasonable care to ensure that all prices displayed on the Platform are accurate, errors may occasionally occur. If we discover an error in the price of a Product that you have ordered, we will notify you as soon as reasonably practicable.

Where the correct price of a Product is higher than the price displayed on the Platform, or where a pricing error is obvious, unmistakable or could reasonably have been recognised by you as a pricing mistake, we reserve the right to cancel the affected Order (or the affected part of the Order) and refund any amounts paid.

You acknowledge that obvious or manifest pricing errors are not binding on Fever and do not create any entitlement to purchase a Product at the incorrect price.

7. PAYMENT

7.1 Payment Methods

We accept a range of payment methods as displayed during checkout, which may include major credit and debit cards (Visa, Mastercard, American Express), digital wallets (Apple Pay, Google Pay) and other locally available payment methods. Available payment methods may vary by Event and jurisdiction.

7.2 Payment Authorisation

By submitting payment, you authorise us (and our payment processors) to charge the Total Price to your selected payment method. Payment must be received in full before an Order Confirmation is issued.

7.3 Instalment Plans

Where instalment payment is available for a Product, this will be indicated during checkout. If you select an instalment plan, you must make all payments by the due dates specified. Failure to make a payment on time may result in cancellation of your Order and forfeiture of amounts already paid, to the extent permitted by applicable law.

7.4 Fraud Prevention

All Orders are subject to fraud screening and verification checks. We reserve the right to place any Order under review where we reasonably suspect fraudulent activity, unauthorised use of a payment method, a breach of these Terms or any other unlawful activity.

As part of our verification procedures, we may request additional information or documentation from you before processing, confirming or fulfilling an Order, including proof of identity, proof of address, proof of payment method ownership, or other information reasonably required to verify the legitimacy of the Order.

If you fail to provide the requested information within the timeframe specified by us, or if we are unable to verify the Order to our reasonable satisfaction, we may suspend, refuse, cancel or limit the Order and refund any amounts paid using the original payment method.

We reserve the right to refuse or cancel any Order and to suspend or terminate your use of the Platform where we reasonably believe that an Order, account or transaction is associated with fraudulent activity, unauthorised resale, use of automated purchasing tools, circumvention of purchase limits, or any other unlawful or prohibited conduct.

We reserve the right to cancel any Order and refund the Total Price if we reasonably suspect fraudulent activity.

7.5 Invoicing

Where required by local tax regulations, a VAT invoice or receipt (as applicable) will be available upon request. Further, where billing details are not fully completed at the time of Ticket purchase, the information provided by you on account set up will be used as billing data where required by applicable regulations.

8. DIGITAL TICKETING AND DELIVERY

8.1 Mobile Tickets

Tickets are delivered primarily in digital format to the email address provided by you (and where available the F1 App). Digital Tickets may include QR codes, barcodes or other machine-readable credentials and may be stored in compatible digital wallets (such as Apple Wallet or Google Wallet). Tickets may be sent to you by us or directly by the relevant Event Promoter.

You are responsible for ensuring that you have a compatible device to display your digital Ticket for entry at the Event.

8.2 Delivery Timing

Digital Tickets will be made available to your email as soon as reasonably practicable after Order Confirmation. For certain Events or Products, Ticket delivery may be delayed until closer to the Event date ("Delayed Release"). Where Delayed Release applies, estimated delivery dates will be communicated in your Order Confirmation or via your email address details. Delivery dates are estimates only and may be affected by Promoter fulfilment schedules.

8.3 Physical Tickets

Where physical Tickets or credential passes are required (for example, for certain hospitality packages), these will be shipped to the address provided in your Order or may be made available for collection at the Event.

8.4 Ticket Accuracy

You must check your Tickets immediately upon receipt (whether digital or physical) and notify us promptly of any errors, including incorrect Event, name, date, category or quantity.

8.5 Lost or Compromised Tickets

If your digital Ticket is lost, deleted or compromised, contact our Customer Support team as soon as possible. We may, at our discretion, reissue a replacement digital Ticket and void the original. We are not responsible for any misuse of Tickets that occurs before you report the issue to us.

8.6 Ticket Changes and Modifications

Where operationally necessary, including where inventory allocations are changed by a Promoter, Fever reserves the right to substitute a Ticket with another Ticket of substantially equivalent value and category for the same Event.

You acknowledge that the relevant Promoter may modify seating layouts, grandstand locations, hospitality areas, viewing areas or general admission areas from time to time and that such changes shall not, of themselves, entitle you to a refund.

8.7 Unauthorised Ticket Resales

We are not responsible for Tickets purchased through unauthorised resale platforms, secondary marketplaces or third-party resellers. Any issues relating to the delivery, validity, transfer or fulfilment of Tickets purchased through such channels must be addressed directly with the relevant seller or platform.

8.8 Ticket Restrictions

Certain Tickets may be subject to specific conditions, restrictions or eligibility requirements, including restricted views, age requirements, accessibility conditions or other limitations. Any such restrictions will be identified in the Product description, applicable Promoter Terms or otherwise communicated during the purchase process. You are responsible for reviewing and complying with all such restrictions.

Tickets may not be used for advertising, promotional, competition, sweepstake, prize draw or other commercial purposes, nor may they be combined, packaged or bundled with travel, accommodation, hospitality, merchandise or any other product or service for resale or commercial gain without FODM’s prior written consent in advance.

9. CUSTOMER CANCELLATIONS

9.1 Customer-Initiated Cancellations

All sales are final. Once an Order Confirmation has been issued, Products may not be cancelled, exchanged or refunded except as expressly provided in these Terms or where required by applicable law.

Due to the nature of live events, Orders cannot be cancelled once an Order Confirmation has been issued, except where applicable consumer protection law provides you with a statutory right of cancellation or withdrawal.

9.2 Partial Attendance

If you attend part of an Event (for example, one day of a multi-day Ticket), you are not entitled to a refund for the remaining days unless the Event is cancelled or materially curtailed in accordance with Section 10.

9.3 Non-Ticket Products Cancellation

Subject to the paragraph below, in respect of Non-Ticket Products and unless otherwise specified in the applicable Non-Ticket Product description or Promoter Terms, you may cancel your purchase of a Non-Ticket Product within fourteen (14) days of receiving the Non-Ticket Product and receive a refund of the price paid for that Non-Ticket Product.

The cancellation right set out above for Non-Ticket Products shall not apply to: (a) digital content which you have already used or viewed; (b) services fully performed before the end of the applicable cancellation period; (c) personalised or customised products; or (d) any other Non-Ticket Product for which a cancellation right is excluded under applicable law.

For the avoidance of doubt, the cancellation of a Non-Ticket Product shall not entitle you to cancel, exchange or obtain a refund in respect of any Ticket purchased as part of the same Order unless expressly provided in these Terms, the applicable Promoter Terms or applicable law.

10. AFFECTED EVENTS AND REFUNDS

For the purposes of this Section 10, an "Affected Event" means an Event that is officially cancelled, postponed, or held behind closed doors.

10.1 Affected Events and Refunds

In respect of Affected Events, the Customer may be entitled to a refund in respect of Products. The default method of refund is a cash refund (to the original payment method) of the Total Price less any non-recoverable Payment Processing Costs and Shipping Fees. Refunds will be processed within a reasonable period of the refund being approved. Payment Processing Costs and Shipping Fees are non-refundable except where applicable consumer law requires their refund.

10.2 Programme Changes

The Event programme, timetable, support races and entertainment schedule are subject to change at any time. Changes to the Event programme do not entitle you to a refund unless the change is so material as to fundamentally alter the nature of the Event, as determined in accordance with applicable law.

10.3 Limitation

Fever shall not be liable for any additional costs, expenses or losses incurred by you as a result of an Event cancellation, postponement, rescheduling or modification, including (without limitation) travel, accommodation, subsistence or consequential losses. See Section 14 (Liability) for further detail.

11. TICKET RESTRICTIONS AND TRANSFERS

11.1 Personal Use

Tickets are sold for personal, non-commercial use only. Each Ticket entitles one named individual to attend the Event for the session(s) and area(s) specified on the Ticket.

11.2 Controlled Digital Transfers

Where enabled for the relevant Event and permitted by the applicable Promoter Terms, you may transfer certain Tickets to another individual through the official transfer functionality available to you, subject to the following conditions:

  • transfers must be completed before any cut-off time specified for the relevant Event;
  • transfers must be made at no more than face value (i.e. the price you originally paid for the Ticket);
  • you may not transfer a Ticket that forms part of a hospitality or experience package unless the entire package is transferred; and
  • the original purchaser remains responsible for ensuring that the transferee complies with these Terms and any Promoter Terms.

11.3 Prohibited Activities

You must not:

  • sell, offer for sale, auction, advertise or otherwise commercially resell any Ticket, whether at face value, above face value or below face value, through any unauthorised channel (including secondary Ticketing platforms, social media, classified advertising sites or any other medium);
  • use Tickets for promotional, advertising, competition, sweepstake or commercial purposes without prior written consent from Fever;
  • transfer or attempt to transfer a Ticket other than through the official transfer functionality described in Section 11.2; or
  • acquire Tickets with the primary intention of reselling them.

11.4 Consequences of Breach

If we reasonably believe that you have breached this Section 11, we may, without prejudice to any other rights or remedies:

  • cancel the relevant Tickets without refund;
  • refuse entry to the Event or require you to leave the Event;
  • suspend or terminate your access to the Platform; and
  • pursue any legal remedies available to us.

12. PROMOTER AND CIRCUIT TERMS

12.1 Promoter Terms

Your attendance at an Event is subject to the Promoter Terms, which may include circuit regulations, conditions of entry, code of conduct, prohibited items lists and other rules. The applicable Promoter Terms are set out above at Section 5.5.

12.2 Acceptance of Promoter Terms

By attending the Event, you agree to comply with the applicable Promoter Terms. Failure to comply may result in refusal of entry or ejection from the Event without refund.

Hierarchy of Terms

In the event of any conflict or inconsistency between these Terms and the Promoter Terms, the Promoter Terms will prevail to the extent of the inconsistency, except where these Terms provide greater protection to the Customer under applicable consumer law.

12.4 Promoter Liability

Fever is responsible for operating the Platform and selling Products through the Platform but is not the organiser, promoter or operator of any Event. Other than the provision and delivery of Products to you, we are, to the maximum extent permitted by applicable law, not liable for any act or omission of any Promoter, circuit operator or their respective agents, employees or contractors, including (without limitation) the condition of the venue, safety arrangements, catering services or any other aspect of the Event experience.

12.5 Event Attendance and Venue Rules

The relevant Promoter and circuit operator reserve the right to refuse admission to, remove from the Event or eject from the venue any person who: (i) is not in possession of a valid Ticket; (ii) fails to comply with these Terms, the applicable Promoter Terms or any venue regulations; or (iii) is considered by the Promoter, circuit operator or relevant authorities to present a risk to health, safety, security or public order.

Unless expressly permitted by the applicable Promoter Terms, you must not create, store, record, transmit, publish or commercially exploit any audio, visual or audiovisual recording of the Event, nor collect, record, transmit or distribute any timing, scoring, race control, performance or other event-related data. Any photographs, recordings or other content captured by you at an Event may only be used for personal, private and non-commercial purposes.

You acknowledge that the Event may be filmed, photographed or otherwise recorded by or on behalf of FODM, the Promoter and their respective partners. By attending the Event, you grant FODM, its affiliates, and their respective licensees a worldwide, perpetual, royalty-free right to use your image, likeness, voice and appearance in any live or recorded audio, visual or audiovisual coverage of the Event and in any related promotional, marketing or commercial materials.

Event dates, schedules, session times, support races, entertainment programmes and venue access arrangements are subject to change. Admission, re-admission and access to specific areas of the venue remain subject to the applicable Promoter Terms and the directions of the Promoter, circuit operator and venue security personnel.

13. PLATFORM TERMS OF USE AND PROHIBITED CONDUCT

13.1 Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not use the Platform in any way that could damage, disable, overburden or impair the Platform or interfere with any other party's use of the Platform.

13.2 Prohibited Conduct

You must not:

  • use any automated tool, bot, script, spider, scraper or other automated means to access the Platform, monitor availability, place Orders or extract data;
  • circumvent, disable or interfere with any security, rate-limiting, bot-detection or access-control features of the Platform;
  • create multiple Platform accounts to circumvent purchase limits or other restrictions;
  • impersonate any person or entity, or misrepresent your identity or affiliation;
  • use the Platform to engage in any form of fraud, money laundering or other financial crime;
  • upload, transmit or distribute any malicious code, virus or other harmful material;
  • attempt to gain unauthorised access to any part of the Platform, its servers or any connected systems; or
  • use the Platform in any manner that violates applicable law or regulation.

13.3 Monitoring and Enforcement

We employ technical measures (including bot detection, velocity checks and behavioural analysis) to detect and prevent prohibited conduct. We reserve the right to:

  • block, suspend or cancel any Order or account associated with prohibited conduct;
  • restrict access to the Platform;
  • report suspected illegal activity to the relevant authorities; and
  • pursue any legal remedies available to us, including claims for damages.

13.4 Account Suspension

We may suspend or terminate your use of the Platform immediately and without notice if we reasonably believe that you have engaged in prohibited conduct. Where we suspend your account, we will notify you of the reason for the suspension and provide you with an opportunity to respond, except where doing so would compromise an ongoing investigation or where we are required by law to act immediately.

14. LIABILITY

14.1 Our Liability to You

Nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any breach of the terms implied by applicable law regarding title and quiet possession; or
  • any other liability that cannot be excluded or limited under applicable law.

14.2 Exclusion of Indirect Losses

Subject to Section 14.1, we shall not be liable to you for any:

  • loss of profit, revenue, business, anticipated savings or goodwill;
  • indirect, consequential, special, punitive or exemplary losses or damages;
  • costs of travel, accommodation, subsistence or any other expenses incurred in connection with an Event (whether or not the Event takes place); or
  • loss of data, loss of opportunity or wasted expenditure,

howsoever arising, whether in contract, tort (including negligence), breach of statutory duty or otherwise.

14.3 Cap on Liability

Subject to Section 14.1, our total aggregate liability to you in connection with any Product shall not exceed the Total Price paid by you for that Product.

14.4 Third-Party Services

Other than in respect of the Products, we are not liable for any products, services or experiences provided by third parties, including Promoters, circuit operators, FOHES, travel providers, accommodation providers and any other third parties. Any claims in respect of such services should be directed to the relevant third party.

14.5 Consumer Rights

If you are a consumer, you may have statutory rights under the laws of your jurisdiction that cannot be excluded or limited by these Terms. Nothing in these Terms affects those rights.

14.6 Assumption of Risk. You acknowledge that motorsport events, including Formula 1 Events and associated activities, involve inherent risks and that attendance is at your own risk. To the maximum extent permitted by applicable law, Fever, FODM and its affiliates, the FIA, the relevant Promoter and persons involved in the organisation, operation or safety of the Event shall not be liable for any loss, injury, damage or inconvenience suffered by you or your property arising from your attendance at the Event, except to the extent caused by their negligence, fraud or any liability that cannot be excluded under applicable law.

15.2 Promoter Customer Support

Certain enquiries or complaints may relate to matters within the control of the relevant Promoter or circuit operator, including venue access, event schedules, seating locations, accessibility arrangements, prohibited items, event-day operations and other event-specific matters. In such cases, you will need to contact the relevant Promoter. Fever will remain responsible for customer communications regarding Platform and Ticket sales matters, but response and resolution times may be affected where information or action is required from the relevant Promoter.

17. INTELLECTUAL PROPERTY

Platform Content

17.1 The Platform and all content made available through it, including text, graphics, logos, images, audiovisual content, software, the Formula 1 logo, the F1 logo, team names and logos, trademarks and other intellectual property, are owned by or licensed to Fever, FODM, the FIA, the relevant teams and/or their respective licensors and are protected by applicable intellectual property laws.

17.2 Nothing in these Terms grants you any ownership rights in the Platform or its content. You may access and use the Platform and its content solely for your personal, non-commercial use in connection with browsing the Platform and purchasing or using Products.

17.3 You may not reproduce, distribute, modify, create derivative works from, publicly display, commercially exploit, reverse engineer, scrape, copy or otherwise use any part of the Platform or its content without the prior written consent of the relevant rights holder.

FODM Content

17.4 The Customer shall not use any of the expressions “Formula 1™”, “Formula 1®”, “F1®”, “FIA Formula 1 World Championship™”, “Formula 1 Paddock Club™”, “Paddock Club™” or any trade marks (whether registered or unregistered) or logo(s) pertaining thereto or any other intellectual property right owned by FOHES, FOHES’s affiliates or by any third party except with the prior written consent of FOHES, its affiliate or the relevant owner or licensee of such trade mark or other intellectual property rights.

17.5 Ownership, possession or use of a Product does not confer any rights (by implication or otherwise) on the Customer to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the Product.

17.6 The Client shall not use the name of the Event (or the name of any other round of the FIA Formula 1 World Championships) or part thereof (nor any abbreviation or foreign language version thereof) nor any logo or graphic device of or relating thereto for any commercial purpose whatsoever without the prior written consent of FOHES or its affiliate first being obtained

18. GENERAL

18.1 Entire Agreement

These Terms (together with the Promoter Terms and, where applicable, the FOHES Terms) constitute the entire agreement between you and Fever in relation to your Order and supersede all prior agreements, representations and understandings.

18.2 Amendments

We may amend these Terms from time to time by publishing the updated version on the Platform. The version of the Terms in force at the time you place your Order will apply to that Order. Material changes will be notified to you via the Platform or by email.

18.3 Assignment

You may not assign, transfer or sub-contract any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to Fever Affiliates or to any successor in title to our business.

18.4 Waiver

No failure or delay by us in exercising any right or remedy shall operate as a waiver of that right or remedy. A waiver of any right or remedy on one occasion shall not prevent us from exercising that right or remedy on any other occasion.

18.5 Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable by any court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be deemed deleted. In either case, the validity and enforceability of the remaining provisions shall not be affected.

18.6 Third-Party Rights

Except as expressly provided in these Terms, no person who is not a party to the contract formed by these Terms shall have any right to enforce any of its terms.

19. GOVERNING LAW AND DISPUTES

19.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of laws principles, except where mandatory provisions of the law of your habitual residence provide otherwise.

19.2 Consumer Jurisdiction

If you are a consumer habitually resident in the European Union, the United Kingdom, Australia, Brazil or any other jurisdiction that grants consumers mandatory forum protections, nothing in these Terms shall deprive you of the protection afforded by the mandatory provisions of the law of your habitual residence.
